Why Written Communication Matters

Putting your requests and concerns in writing is one of the most important things you can do as a parent advocate. Written communication creates a legal record, ensures clarity, and triggers specific timelines under IDEA. A verbal request can be denied or forgotten; a written request is documented proof.

Tips for all letters:

Letter 1: Request for Initial Special Education Evaluation

Use this letter when you want the school to evaluate your child for special education services for the first time.

[Your Name] [Your Address] [City, State, ZIP] [Date] [Principal's Name] [School Name] [School Address] [City, State, ZIP] Re: Request for Special Education Evaluation for [Child's Full Name] Date of Birth: [DOB] Grade: [Grade] School: [School Name] Dear [Principal's Name], I am writing to formally request a comprehensive evaluation of my child, [child's name], for special education services under the Individuals with Disabilities Education Act (IDEA). I believe my child may have a disability that is affecting their ability to learn and make progress in school. My specific concerns are: [Describe your concerns in detail. Examples:] - [Child's name] is currently reading significantly below grade level. Their most recent assessment shows they are reading at a [X] grade level while in [Y] grade. - [Child's name] has difficulty sustaining attention during classroom instruction and frequently does not complete assignments. - [Child's name] struggles with [specific academic, behavioral, social, or functional areas]. I am requesting that the evaluation include assessment in all areas related to the suspected disability, including but not limited to: - Cognitive ability - Academic achievement (reading, writing, math) - [Speech and language / behavioral and emotional functioning / attention and executive functioning / occupational therapy / other areas as appropriate] I understand that under IDEA, the school has a legal obligation to respond to this request in writing within a reasonable time. I also understand that the evaluation must be completed within 60 days of my written consent to evaluate [or your state's specific timeline]. Please provide me with the consent-to-evaluate form and written notice of the school's decision regarding this request. I would also like a copy of my Procedural Safeguards (parents' rights). Thank you for your attention to this matter. I look forward to your response. Sincerely, [Your Name] [Phone Number] [Email Address] cc: [Special Education Director's Name], [School District Name]

Letter 2: Disagreement with IEP / Prior Written Notice Request

Use this letter when you disagree with a decision the IEP team has made (denial of services, inadequate goals, placement decision, etc.).

[Your Name] [Your Address] [City, State, ZIP] [Date] [Special Education Director's Name] [School District Name] [Address] [City, State, ZIP] Re: Disagreement with IEP Team Decision for [Child's Full Name] Date of Birth: [DOB] School: [School Name] Dear [Special Education Director's Name], I am writing to express my disagreement with the decision made at the IEP meeting held on [date]. Specifically, I disagree with the following: [Describe the specific decision(s) you disagree with. Be specific. Examples:] - The team's decision to reduce speech therapy services from 3 sessions per week to 1 session per week. The progress data shows that [child's name] has not yet met their speech goals and continues to need intensive services. - The proposed IEP goals in reading, which I believe are not sufficiently ambitious. [Child's name]'s current reading level is [X] and the proposed goal of [Y] represents minimal growth. - The team's refusal to conduct a Functional Behavioral Assessment despite ongoing behavioral concerns. I am requesting the following: 1. Prior Written Notice (PWN): Under 34 CFR 300.503, I am requesting that the school district provide me with Prior Written Notice explaining: the action being proposed or refused, the reasons for the decision, the evaluation data and other factors the team considered, a description of other options considered and why they were rejected, and my procedural safeguards. 2. [State your requested resolution. Examples:] - I request that speech therapy services be maintained at 3 sessions per week pending further data collection. - I request an IEP meeting to discuss revised goals with more ambitious targets. - I request that an FBA be conducted within 30 days. I want to work collaboratively with the school to ensure [child's name] receives a free appropriate public education. However, I also want to make sure my disagreement is documented in the record. Please respond in writing within 10 school days. Sincerely, [Your Name] [Phone Number] [Email Address] cc: [Principal's Name], [School Name]

Letter 3: Request for Independent Educational Evaluation (IEE)

Use this letter when you disagree with the school's evaluation and want an independent evaluation at school expense.

[Your Name] [Your Address] [City, State, ZIP] [Date] [Special Education Director's Name] [School District Name] [Address] [City, State, ZIP] Re: Request for Independent Educational Evaluation at Public Expense Student: [Child's Full Name] Date of Birth: [DOB] School: [School Name] Dear [Special Education Director's Name], I am writing to formally request an Independent Educational Evaluation (IEE) at public expense for my child, [child's name], pursuant to 34 CFR 300.502. I disagree with the evaluation conducted by the school district on [date(s) of evaluation]. [Optional: briefly state why you disagree. Examples:] - I believe the evaluation did not adequately assess all areas of suspected disability. - The evaluation results do not accurately reflect my child's abilities and challenges as I observe them at home and as reported by [child's name]'s private therapist. - The evaluation did not include a neuropsychological assessment, which I believe is necessary to fully understand my child's learning profile. Under IDEA, when a parent disagrees with a school district's evaluation, the parent has the right to an IEE at public expense. The school district must either agree to fund the IEE or file for a due process hearing to demonstrate that its evaluation was appropriate. The district must act without unnecessary delay. I am requesting the following: 1. The district's criteria for Independent Educational Evaluations, including the approved evaluator list and allowable cost range. 2. Written confirmation that the district will fund the IEE. I understand that the evaluation must meet the same criteria the district uses for its own evaluations, as specified in 34 CFR 300.502(e). Please respond to this request in writing within 10 school days. Sincerely, [Your Name] [Phone Number] [Email Address]
